A possible workaround for 3DS shooters is to use the gyroscope for aiming. For example, moving the 3DS would in turn move the aiming reticule around the screen. That alone gives you both the shoulder buttons and all four face buttons to play with. Of course, this would make viewing the game in 3D pretty difficult.
I'm pretty sure this is already being done on the iPhone 4 — maybe we'll see Gameloft pioneering this control scheme on 3DSWare, possibly with NOVA 3D? :3
